A husband who contracted $exually transmitted disease while cheating on his wife has sued the Kenyan government to court for the outcome of using a condom that broke while he was away with his sex partner.
Joined in the suit are a pharmaceutical company, Kenya Revenue Authority and Kenya Bureau of Standards.
The petitioner, in his narration to CitizenTV Kenya explained how he used his favorite brand of condoms, Zoom scented chocolate flavoured studded condoms, believing he would please his sexual partner and protect him fully but unfortunately, it broke during intercourse!
As a result of infecting his wife after contracting STI due to the use of fake condoms his wife has gone ahead to divorced him, his sworn affidavit revealed.
“Whilst I was having sexual intercourse with the woman, the said condom broke — a fact which I only realised after the act.
“That at the time, I brushed the incident as a non-issue and three days later, I still had sexual intercourse with my wife,” the unnamed petitioner, who also fears he might have contracted HIV, said.
In a further informtion credited to Punch, the petitioner claimed that the said product dubbed “The impugned batch” was originally meant to be sold in Uganda but failed all the qualitative tests, leading to the regulatory body in the country declaring it unfit for intended use.
The petitioner now says that following the incident, he suffered a mental breakdown, lost his family and became an alcoholic and subsequently lost his job as a result.
The man claims that he was later told by his friends that some of them had experienced condom breaks from the same brand of condoms.
